Big Rig Accident
Cintron v. Los Angeles Machinery
Verdict: $4,750,000

  • Anthony Cintron was driving a truck and trailer combination in Madera, California, when an improperly loaded pallet of heavy machinery fell on him and crushed his foot on June 17, 2002. Mr. Cintron was picking up a load of heavy equipment that had been prepared for him by Los Angeles Machinery Moving, Inc., of Los Angeles. The dismantled machine had been loaded onto two pallets, each weighing 1 ton. One of the pallets had been safely loaded onto another truck, but the remaining one was balanced precariously on a loading station on rollers and not locked into position.
  • What was worse, the head rigger from Los Angeles Machinery Moving, who was in a hurry, refused to allow Cintron to chain the loading station as he wished and insisted on chaining it in a way that did not restrain the pallet. Eight miles down the road, Cintron stopped to adjust the load and the pallet fell on him, crushing his foot. A Los Angeles County Superior Court jury awarded Anthony Cintron, 31, of Haleyville, Alabama, $4,754,648.23 in compensation for the severe damage that occurred
Bicycle /  Truck Accident
Steinwedel vs. Yuba Trucking

  • Jeffrey Steinwedel was riding his bicycle along Stevens Canyon Road in Cupertino when he was run over and killed by a double–dump trailer which was trying to pass. When apprehended, the driver of the truck denied any involvement in the accident.
  • A subsequent inspection of the truck's trailer disclosed fibers from Mr. Steinwedel's clothing, and paint from his bicycle, proving that it was indeed the rig which struck Mr. Steinwedel. It was also clear from the accident reconstruction that there was more than enough room for the truck driver to safely pass Mr. Steinwedel. The Firm demonstrated that it was the driver's lack of experience and training, as well as his lack of concern for a bicycle rider, which were the sole causes of Mr. Steinwedel's death.
  • Charges of vehicular manslaughter were brought against the truck driver. O'Reilly & Danko worked with the District Attorney to establish the evidence needed to identify and conclusively prove that the defendants' driver was indeed the one who had hit Mr. Steinwedel and that the accident was the driver's fault, not Mr. Steinwedel's. The driver was ultimately convicted and O'Reilly & Danko negotiated settlements against the driver's employer totaling $5,000,000.
