Our clients' family member and another person were piloting a heavy-lift helicopter during a logging operation when the helicopter malfunctioned. The resulting crash killed both pilots.

We investigated the accident and determined that the aircraft's right cyclic dual hydraulic servo actuator failed. Due to this equipment failure, the pilots were unable to drop a load of logs. When the helicopter became uncontrollable, it crashed to the ground.

The manufacturer claimed that the equipment failure was caused by 1) poor maintenance in the field, and 2) pilots' marijuana use. We proved that poor maintenance was the result of confusing maintenance manuals and that toxicological test results indicated exposure to second-hand smoke, not marijuana use. The jury agreed with us and awarded the pilots' families $9.14 million.
